However the jury has rights of open & honest communication leading to a fair decision with responsible & knowable results. Therefore the defendent & jury have rights to request more information, evidence, facts & opinions in the due process.
Spontaneous Objections, appeals & proposals to the judge by the prosecution & defence need to be quickly explained to the jury upon request, before other information drowns the request of understanding.
Witnesses & accused may be questioned by the defendent, prosecution & jury with assistence of judge, who may be questioned about the law, facts & due-process in present case, & after testimony that appeared incomplete to jury or defendent or prosecution.
In reaching a fair decision the jury may or must be advised of the range of sentence for a guilty verdict. In some cases the jury may decide the sentence, with a fair range proposed by the judge, &or requested by the prosecution. The jury will be excused to discuss, vote & decide about the case in private & not explain the decision afterwords if asked.
A decision is reached when all jurists agree on guilt/innosense, then presented to the whole public court. The sentence will then be decided on after the verdict, & the criminal & integrity history of the defendent is openly explored to juries & judgles satisfaction.
PUNISHMENT via PROBATION, PAROLE, FULL & REDUCED SENTENCE, accountability & feedback of completion
The current ‘justice system’ is so complex, expensive & distant from daily community life, that most convictions, sentences & completion of such are unknown to jurors, witnesses & victims in a case. Also the results of prison, fine & community service as punishment & rehabilitation are so vague, negative & secret=hidden from with those involved in the crime that no real therapy happens in most cases. Therefore the whole justice system needs to be naturalized, localized & simplified to create peace, trust & cooperation in neighborhoods (is possible) instead of the stress,secrets, fear & violence so common in most communities.
To make hearings more fair, open & honest with facts, trails dates & decisions & senstences; paroles, probations & appeals should be published = announced to the community to insure public awareness of whole due- process at work. Also the public must be educated openly & simply before any trails, so most in community can participate is effected, needed or ???
