INFORMATION ON DRIVING UNDER THE INFLUENCE OF INTOXICANTS (DUII or DWI) NEED HELP? Read the following information for motorist who are stopped for driving under the influence in Oregon or just call attorney Robert J. Larson at 541 343 3640 or 541 686 9100. The first 10 days can be crucial as to whether or not you lose your driver's license in Oregon.

Requesting a hearing gives you an opportunity to save your license. Don't wait until the last minute. DUII/DWI laws have been made even more harsh as to breath tests, diversion and penalties for refusing breath test and suspension of driver's licenses. The 2009 Legislature lengthened the period for qualifying for diversion to 15 years and increased the minimum fine for blowing .15 to $2,000. In Lane County the Courts are in some cases requiring the installation of a costly ignition interlock device as a condition of diversion which lasts a year.

The Oregon Supreme Court in State v. Machuca, overruled the Court of Appeals decision and held a search warrant was not required to obtain a blood sample from a defendant who after an accident consented to a blood test while in a hospital room after being advised of the implied consent law and the fact if he refused his license would be suspended. Case opinion filed February 11, 2010.
